Can You Use Section 8 for Assisted Living Services?

In this article we will try to provide you with all the necessary information about Section 8, assisted living within Section 8, and elderly persons’ eligibility for this type of program.

What is section 8?

Section 8 of the Housing Act of 1937, or the Housing Choice Vouchers Program, is the government’s program that offers housing for the following American citizens:

  • families with low-income
  • elderly people
  • people with disabilities

The Section 8 Housing program helps the aforementioned people with finding and renting affordable housing in a community administered either by Local Public Housing Agencies (PHA) or the local municipal public housing agencies. The program offers rental assistance only, which means that section 8 vouchers do apply for assisted living facilities, but they cannot be used to pay for meals or services.

So, to answer the titular question about Section 8:  assisted living can be applied for via housing vouchers, but they will pay for the room only, whereas food and services are not included.

Senior housing facilities that are in the Section 8 housing program are licensed and regulated by the state, and if everything checks out, these facilities enter the HAP (Housing Assistance Payment) contract.

Which Residents Are Eligible For Section 8 Vouchers?

Residents with income at 50% of the Area Median Income or lower are eligible for Section 8 vouchers. Since the demand for these vouchers is fairly high, and the waiting lists very long (in some areas families wait for months, even years, for this type of assistance), each local housing assistance agency establishes its own triage method and has its own set of priority rules when it comes to deciding which families or individuals are eligible to receive rent vouchers first.

As far as elderly people’s eligibility is concerned, the residents are supposed to meet the admissions/discharge assisted living requirements that are established either by the state and local licensing or HUD (U.S. Department of Housing and Urban Development) frailty requirements under 24 CFR 891.205.

The elderly residents must be able to live independently, but are allowed to have some needs for assistance with the following daily living activities:

  • eating
  • bathing
  • grooming
  • dressing
  • home management activities

When it comes to the rights of the elderly residents, they have the right to expect the housing to be available to them without any type of discrimination/limitations based on:

  • race
  • color
  • religion
  • sex
  • handicap
  • familial status
  • national origin

The residents have the right to expect equal professional service regardless of the factors listed above, while they also have the right to have a broad range of housing choices without any discrimination when it comes to the pricing or financing of housing.

How To Apply For Section 8 Vouchers

  1. Find the senior housing community you like, contact them and see if they are in the Section 8 program.
  2. Submit your application for funding. During this process, the Local Public Housing Agency (PHA) will be collecting and verifying the income, assets, and family composition data via other local agencies, your employer, the bank…
  3. The PHA will then use this information to determine your Section 8 eligibility, as well as the amount of your possible housing assistance payment.
  4. Should the PHA determine that you are eligible, the agency might assist you immediately, or put your name on a Section 8 waiting list and hopefully contact you with a housing voucher once your name is up next.
